What is Covered in this Training?

  1. This program provides the BOT Contract Drafting Training participant the essential Understanding, Competencies, Skills, Process Knowledge and Management Guidance to perform his Contract Drafting Skills Training Assignment in an effective, efficient, customer focused manner, always targeting Win-Win, Protecting his Organization, and helping Meet the Operational & Strategic Objectives.
  2. Participants will gain a full Multi-Discipline Multi-Stakeholder Understanding of the BOT/PPP Contract Drafting Processes he will be required to Plan, Execute, Supervise and Manage.
  3. Effective Drafting of BOT/PPP Contracts requires: an understanding of the Usual and Special Project Risks on these contracts; deciding which party will bear how much of the risk; analyzing if there are any legal issues in transferring that risk; drafting the contract provision to effectively transfer the risk to the intended party, and, performing a Review of the Drafted Contract for Ambiguities and Conflicting Requirements.
  4. Drafting BOT/PPP conditions require a deep understanding of how any drafted provisions will actually be interpreted according to Local or Law of Jurisdiction, or, Arbitrators and Courts.
  5. This program will approach the BOT or PPP Contract Drafting in a Step by Step Manner, Starting from, Identifying the Organizational BOT/PPP Strategic Objectives, to Identifying the Specific Project Risks, Filling any Project Viability Gaps, Drafting Contract & Conditions, and, Drafting any Changes during Tendering Stage.
